2.a) Ordinance 24-22 of the City of Dunedin, Florida amending Section 107-41.1, Unlawful Noise, of the City of Dunedin Land Development Code to provide for interpretive clarity related to amplified sound and to clarify amplified sound may be heard outside the property line on New Years Eve and may never exceed a weighted 65 Decibel measured at the property line.
Never exceeed 65 decibels? Do you know how loud that actually is? Normal conversation is between 60-70 decibels, so I can't talk outside either. So where does this end? Do we send in our citizens at 11 PM if they are at their pool and listening to a radio above 65 decibels? It is a ridiculous level and needs to be readdressed.
A cardinal change to this 2008 Ord. When enforced correctly.

The noise ord. was in harmony until a local resident filed a lawsuit action & appeal with the City over non enforcement of the sound Ord. Both actions were ruled in favor of the City. After that time dis-harmony about sound started by one individual misinforming the PCSO about how to enforce the code. This disharmony was focused on 107-41.1 H) & I) of Sec. 107-41.1. Claiming the Ord. said any sound heard was a violation. Impossible to comply as calibrated eardrums do not exist. The natural/ambient sound of Dunedin is above the 65db limit of the Ord.
I agree with the City Manager taking the extra step of inserting clarifying wording to 107-41.1 H) & I)
The Sound Ordinance has shown it works since 2008 IF ENFOCED PER THE ORDINANCE INTENT .This clarification will put a stop to circumvention attempts we are experiencing now.
As a life-long resident, 66 years, and a former business owner who spent 20 years helping to build the downtown into what it is today, I hope the notice to vacate will not be enforced when the business complies with the rule. I completely support the businesses of downtown and hope they can continue to thrive as they should. The city manager clarification of sound ordinance is correct as I was on the original drafting committee for that ordinance.

I oppose any changes and want more enforcement, as there doesn't seem to be any.
