Ive lived in Dunedin all 41 years of my life and i enjoy how people can have fun later in the evinings and love that doewntown has a happy night life. please keep it fun and dont spoil dunedin for the ones who have been here and been proud of what it has grown into.
I want to commend the City Manager in regards to her recent written clarification of the sound ordinance. I was on the original task force in 2008 that presented this ordinance to the City. When the ordinance was first published, I asked for, and received a written clarification from then assistant City Manager Harry Gross that said “the intent of the ordinance was that the 65 db standard would be maintained. It just moves to the property line of the source of the music at 11pm”. (see attachment) The sound ordinance was correctly enforced for 10 years with no issues. In 2018 and again in 2023, a Dunedin citizen advised the Sheriff’s Dept wrongly which led to wrongful enforcement and harassment of our business and it's employees. This issue was brought to the attention of the City Manager who after much thorough investigation came to the conclusion that a second clarification may help those reading the ordinance so that it is interpreted and followed correctly in the future.
I support the City Manager's intention to codify the original intent of the sound ordinance with her 2024 memorandum, as well as the past Resolution for a variance on NYE til 12:30am. These seem to be necessary clarifications in order to ensure the original spirit of the law (and our downtown) is maintained. Having read the City Manager's determination, I agree as the operator of a small business that has hosted many a concert (week and weekend) since 2001.
For clarity, 65 decibels is the equivalent to a normal conversation heard from 3 feet away. This is able to be maintained by existing businesses who host entertainment inside on weekends past 11pm, and has a proven track record since inception in 2008. This has always been very fair towards residents and businesses alike as long as properly enforced.
