2.a) Request to table the First Reading of the Stirling Hotel/Dunedin Residences Design Review Application 21-09 located at 380 Main Street and 830 Douglas Avenue.

    The Stirling Hotel project does not meet the minimum requirements of a “Condo-Hotel” as set forth in the Municipal Code. Design Review Application 29-01 should be denied until Applicant submits a compliant design and business model.

    Section 107-33.2.1 (F) entitled “Condo-Hotel Establishment” prohibits an individual, corporation or legal entity from owning more than 5% of the total units. At the November 10, 2021 LPA meeting the representative stated that they will be retaining fee-simple ownership of over 50% of the units. LPA Meeting video at 2:00.00
    Section 107-33.2.2 (D) entitled “Condo-Hotel Unit” mandates that the project contain “uniform and identical cooking facilities in every unit”. Drawings include a variety of kitchen designs in violation of code.
    Section 103.23.24.5 states that no condo-hotel rental unit can exceed 600SF. Drawings include Two and Three Bedroom units as large as1250sf. in violation of the applicable code.
    Beautiful project. Just not a Condo-Hotel
